Opphavsrett: Høyesterett gir vederlag for bildebruk

Høyesterett har nå avsagt dom i saken mellom Andy Finch og The Arctic Challenge (TAC) i saken mot Tromsø 2018 AS. Sistnevnte hadde brukt et bilde av Finch da han deltok i et tidligere arrangement i regi av TAC, der man så ryggsiden til Finch i det han hopper opp i luften. Det oppsiktsvekkende med saken er nok ikke at Finch fikk kompensasjon for bildebruken, men modellen Høyesterett legger til grunn i sitt resonnement. I sin vurdering går Høyesterett ikke inn på forholdet til ytringsfrihet, men ser heller på bildebruken som et opphavsrettslig inngrep som må vurderes på ulovfestet grunnlag. Dommen er avsagt med svak dissens (4-1).

Opphavsrett: Telenor frikjent for medvirkning

Asker og Bærum tingrett avsa 6. november kjennelse i forføyningssak mot Telenor. Norges samlede rettighetshavere innen film og musikk hadde krevd at Telenor ble pålagt å stenge for tilgang til nettstedet Pirate Bay for sine kunder. Retten måtte ta stilling til spørsmål av stor rettspolitisk betydning, og avgjørelsen bærer preg av en viss forsiktighet fra rettens side. Telenor fikk medhold, men retten viste til at saken som sådan hadde reist nok tvil til at det ikke ble tilkjent saksomkostninger.

TV2 acquitted in lible suit

TV2 was sued for alleged infamations in the documentary "Divers in deep water" which aired in May 2007. The documentary criticized the North Sea Divers Alliance (NSDA) for certain actions taken by leaders in this organisation. Bergen City court ruled in favour of TV2AS and also awarded TV2 AS nearly 1,4 million to cover the costs of the case.

Freedom of Speech: Norwegian Law applicable for bookseller

JusNytt_bokhandlerBorgarting Court of Appeals has recently ruled in the question of applicable law for the case about the book "The Bookseller of Kabul". The background for this ruling was that the bookseller had alleged that the main case had to be tried according to Aghan law, because the effects of the claimed damage occured in Afghanistan and not in Norway. The booksellers arguments find support in a recent book about choice of law.

Trademark: Revealing Domain Name Statistics

WIPO have recently published the periodic statistical information on the UDRP process, which has been up and running for close to ten years. These numbers clearly demonstrate that it is the complaining party which wins most of these cases regarding Internet domain name conflicts.

These rulings have over time led to a silent change og paradigm, wherein freedom of speech is awarded a greater part in the legal landscape. Consequently, traditional values related to the balancing of freedom of speech and similer human rights are not necessarily correct after these rulings from Strasbourg, creating a demand for up to date legal insight into this area of law.
