The court pointed out the documentary dealt with issues of considerable public interest, that the two plaintiffs from the NSDA were to be considered as public figures and that the statements in question were made by sources who presented these openly in the film. The court also found that the statements made in the documentary had sufficient factual basis. In weighing the interests of the European Convention of Human Rights (ECHR) article 10 and 8, the court found that the statements were not against the law, and that the critical angle in the documentary was well founded.
