Høyesterett avsa høsten 2010 dom i den første saken her til lands om kildevernet rekkevidde på Internett. Saken gjaldt politiets begjæring om utlevering av IP-adresse på bakgrunn av en persons egenpubliserte informasjon om et straffbart forhold med ham selv som gjerningsmann. Gjennom denne dommen kommer kildevernets prinsippielle begrunnelse klart til uttrykk.

JusNytt_wipo_logoWIPO har i dag lansert WIPO Lex. Dette er en gratis nettjeneste som inneholder rettskilder innen opphavsrett fra en rekke ulike jurisdiksjoner over hele verden. Målsetningen er å kunne tilby en fullverdig database som gir en oversikt over nasjonal lovgivning og forpliktende konvensjoner for alle land som ligger i systemet.

Ytringsfrihet: Kildevernet styrket etter Sanoma

JusNytt_nederland_dojDen europeiske menneskerettighetsdomstol (EMD) kan i spesielt viktige saker samles Klonopin i såkalt storkammer, altså EMD i plenum. Den 14. september 2010 kom det en slik viktig storkammeravgjørelse, i saken mellom mediebedriften Sanoma Uitgevers mot den nedelandske stat. Staten hadde ved påtalemyndigheten pålagt journalister i bladet Autoweek å levere ut råopptak gjort i forbindelse med en reportasje. Det spesielle her var at bildene fra opptakene ble hevdet å kunne vise en fluktbil benyttet under et ran. Bladet nektet å utlevere bevisene, og vant frem. Nå har det Nederlandske justisdepartementet uttalt at man vil styrke pressens kildevern som en konsekvens av avgjørelsen.

The Norwegian market is characterised by high demographic penetration with regard to modern communications technology with consumers, as well as the underlying technological infrastructure. 

Content and Media
Freedom of Speech, Distribution of Content and Liability
Rulings on Human Rights from the court in Strasbourg have significant impact on national laws and regulations related to (amongst others) freedom of speech. These rulings have over time led to a silent change og paradigm, wherein freedom of speech is awarded a greater part in the legal landscape. Consequently, traditional values related to the balancing of freedom of speech and similer human rights are not necessarily correct after these rulings from Strasbourg, creating a demand for up to date legal insight into this area of law.
