Beskrivelse Spørsmål om pressedekning av kriminaletterforskning, der avisen i en tidlig fase omtalte en som var i politiets søkelys anonymt, men likevel slik at noen ville kunne identifisere vedkommende. Norge ble dømt for brudd på artikkel 8 i EMK.

Avisen Fædrelandsvennen hadde omtalt politiets etterforskning i baneheia-saken knyttet mot en ikke-navngitt person. Avisen ble frifunnet i Høyesterett, men saken ble klaget inn for EMD, der den omtalte fikk medhold i sin anførsel om at det forelå et brudd på artikkel 8.

Den omtalte forsøkte deretter å få saken gjenopptatt for Høyesterett igjen i Norge, men fikk ikke medhold i gjenåpningsbegjæringen.

Avisen var i Norge dømt for injurierende omtale i forbindelse med en sak om boplikt. EMK konkluderte med at omtalen lå innenfor de rammer som oppstilles av EMK artikkel 10.

EMD tok utgangspunkt i at de fremsatte utsagn var å anse som faktautsagn (altså at det ikke var snakk om verdivurderinger), og la deretter vekt på at det var snakk om en sak med aktuell og almenn interesse, at avisen hadde tatt forbehold og at man hadde tatt tilstrekkelig skritt med tanke på å verifisere de opplysninger saken gjaldt.

The Norwegian market is characterised by high demographic penetration with regard to modern communications technology with consumers, as well as the underlying technological infrastructure.

Freedom of Speech, Distribution of Content and Liability
Rulings on Human Rights from the court in Strasbourg have significant impact on national laws and regulations related to (amongst others) freedom of speech. These rulings have over time led to a silent change og paradigm, wherein freedom of speech is awarded a greater part in the legal landscape. Consequently, traditional values related to the balancing of freedom of speech and similer human rights are not necessarily correct after these rulings from Strasbourg, creating a demand for up to date legal insight into this area of law.
