Asker og Bærum tingrett avsa 6. november kjennelse i forføyningssak mot Telenor. Norges samlede rettighetshavere innen film og musikk hadde krevd at Telenor ble pålagt å stenge for tilgang til nettstedet Pirate Bay for sine kunder. Retten måtte ta stilling til spørsmål av stor rettspolitisk betydning, og avgjørelsen bærer preg av en viss forsiktighet fra rettens side. Telenor fikk medhold, men retten viste til at saken som sådan hadde reist nok tvil til at det ikke ble tilkjent saksomkostninger.

TV2 frikjent i injuriesak

Official logoTV 2 AS var saksøkt av de to frontfigurene i Nordsjødykkeralliansen (NSDA) for ærekrenkelser fremsatt i dokumentarprogrammet "Dykkere på dypt vann" som ble sendt i mai 2007. I dokumentaren ble det satt et kritisk søkelys på NSDA og frontfiguerens opptreden i ulike sammenhenger. Bergen tingrett har i dom av 22. april 2009 frikjent TV 2 AS fullstendig og pålagt de to saksøkerne å betale sakens omkostninger med ca kr 1,4 millioner.

Ytringsfrihet: Norsk lov i bokhandler-saken

JusNytt_bokhandlerBorgarting lagmannsrett har nå avsagt dom i spørsmålet om lovvalget i bokhandler-saken. Bakgrunnen for problemstillingen var bokhandlerens anførsel om at saken måtte behandles etter afghansk rett fordi hoveddelen av de skadevirkningene som man hevder å ha blitt utsatt for inntraff i Afghanistan og ikke i Norge. Bokhandlerens anførsler har støtte i en egen bok om lovvalg, som nettopp diskuterer lovvalget i bokhandlersaken.

Freedom of Speech, Distribution of Content and Liability
Rulings on Human Rights from the court in Strasbourg have significant impact on national laws and regulations related to (amongst others) freedom of speech. These rulings have over time led to a silent change og paradigm, wherein freedom of speech is awarded a greater part in the legal landscape. Consequently, traditional values related to the balancing of freedom of speech and similer human rights are not necessarily correct after these rulings from Strasbourg, creating a demand for up to date legal insight into this area of law.
